Terms of Use

These terms are the agreement between you and Tenantly when you use the service. The most important thing to know is in section 3: Tenantly gives you information to help you understand a document, not legal advice. Please read it.

1. Who we are and what this is

Tenantly (“Tenantly”, “the service”, “we”, “us”) is a product of Optimised-AI, a business based in South Africa. You can reach us at info@optimised-ai.com.

By creating an account or using the service, you agree to these terms. If you do not agree, please do not use the service. This is an agreement concluded electronically under South Africa's Electronic Communications and Transactions Act 25 of 2002 (ECTA).

2. What Tenantly does

Tenantly helps you understand tenant-facing property documents.

  • Lease and document scan: you submit a lease, notice or similar document and receive a Lease Health Score, plain-English findings, and references to the tenant-protection law of the country or region you choose.
  • Landlord tools: you can build tenant-facing documents and keep simple tenant records.
  • Your result can be downloaded as a PDF for your own records.

3. Information, not legal advice

This is the most important term. Tenantly gives you general information to help you understand a document. Tenantly is not a law firm and does not give legal advice, and using it does not create an attorney-client relationship.

The Health Score, the findings and the legal references are generated automatically and may be incomplete, out of date or wrong. They must not be relied on as legal advice or as a substitute for a qualified professional. For advice about your own situation, speak to an attorney or the relevant rental housing tribunal or authority in your area.

You are responsible for any decision you make or action you take. To the maximum extent allowed by law, Optimised-AI is not liable for anything done or not done in reliance on the service's output.

4. Who may use Tenantly

You must be at least 18 years old. You agree to give accurate account information and to keep your login details secure. You are responsible for activity under your account, and you agree to tell us promptly if you think it has been used without your permission.

5. Your content, and how responsibility is split

“Your content” means the documents, text and tenant details you submit to the service.

For your content, you are the responsible party under POPIA and Tenantly acts as your operator, processing it on your instruction to give you the result. For the platform itself (your account, security, and the processing set out in the Privacy & POPIA notice), Optimised-AI is the responsible party.

You confirm that you are entitled to submit your content and to have it processed, and that doing so does not break anyone's rights or any duty of confidentiality. Please do not submit content you are not allowed to share.

6. Acceptable use

You agree not to: use the service unlawfully or on any unlawful document; use the output to harass, threaten or mislead anyone; copy, scrape, reverse-engineer or overload the service; resell or white-label it without our written permission; or upload anything malicious. We may suspend access if the service is misused.

7. Payments and pricing

The Lease Health Score is free and needs no sign-up. Paid features, such as a deeper clause-by-clause review and landlord plans, are being rolled out. When a feature is paid, its price and what it includes are shown before you pay, and payment is handled by a secure payment provider. Your rights under the Consumer Protection Act 68 of 2008 apply where relevant.

8. Intellectual property

The service, its review engine, its legal rule packs, and the Tenantly name and branding are owned by Optimised-AI. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You keep ownership of your content, and you give us the limited licence we need to store and process it in order to provide the service to you.

9. Availability and changes

The service is provided on an “as is” and “as available” basis. We may add, change, suspend or remove features, and we may carry out maintenance. We may update these terms from time to time; when a change is significant we will make it clear in the app, and continued use after that means you accept the updated terms.

10. Limitation of liability

To the maximum extent permitted by law, Optimised-AI is not liable for any indirect or consequential loss, or for loss arising from reliance on the service's output. Nothing in these terms limits any liability that cannot be limited under South African law, including certain rights you have under the Consumer Protection Act.

11. Indemnity

To the extent permitted by law, you agree to cover Optimised-AI against claims, losses and reasonable costs that arise from your content or from your misuse of the service.

12. Suspending or closing your account

We may suspend or close an account that breaches these terms. You may close your own account at any time in Settings. Some information may be kept where the law requires it, as set out in the Privacy & POPIA notice.

13. Governing law

These terms are governed by the law of South Africa, and the courts of South Africa have jurisdiction. Where we can, we would rather sort out any issue with you directly, so please contact us first.
